Key Updates in the New Foreigners’ Residence Law
The new law, spanning 36 articles across seven chapters, replaces the long-standing 1959 Amiri Decree No. 17. It provides innovative solutions to existing gaps, including:

1. Extended Newborn Residency Registration
The timeframe for registering newborns under expatriate residency has been extended to four months from birth, eliminating legal complications for parents previously caused by shorter deadlines.

2. Flexible Visit Visa Policies
Foreigners entering Kuwait on visit visas can now stay for up to three months, with the option for renewal. Temporary residency permits are available for periods ranging from three months to one year, contingent on Ministry of Interior approval.

3. Long-Term Residency Options
Ordinary residency permits are now valid for up to five years for expatriates.
Certain groups, such as children of Kuwaiti citizens and property investors, may obtain residency for up to ten years.
Investors and children of Kuwaiti citizens are exempted from the six-month rule for leaving the country without jeopardizing their residency.
Tackling Residency Trafficking and Misuse

The law dedicates an entire chapter to combat residency trafficking, introducing strict measures against illegal practices like:

Exploiting foreigners for recruitment or residency renewal.
Employing individuals in unlicensed roles.
Penalties:

Imprisonment ranging from 3–5 years.
Fines between 5,000 and 10,000 KD.
5. Prohibitions on Employment Violations
Employers face steep fines (3,000 KD) for violating employment laws, such as:

Assigning workers to roles outside their intended purpose.
Permitting foreigners to work without appropriate sponsorship.
Harboring expatriates with expired residency.
Humanitarian Provisions for Deportees
The law incorporates compassionate measures, allowing deportees time to settle their affairs before leaving Kuwait. The Ministry of Interior may grant a grace period for individuals to liquidate interests or manage other essential matters.
