KUWAIT CITY, Oct 1: In a significant development for labor regulations, the First Deputy Prime Minister, Minister of Defense, and Minister of Interior Sheikh Fahad Yousef Al- Sabah, has amended the rules governing the transfer of workers between employers.
This decision introduces specific guidelines for the transfer of workers on government contracts to the private sector, effective November 3, 2024. The new directive includes the cancellation of Clause No. 5 of Article No. 3 of PAM Resolution No. 842 of 2015, which previously restricted the transfer of expatriate workers to the cooperative societies and unions sector.
Under the amended regulations, workers who were brought into the country to work on government contracts and projects will now be allowed to transfer to sectors outside of government contracts, provided they meet certain conditions.


The decision outlines five conditions that must be fulfilled for the transfer of these workers:

1. The government contract or project must have been terminated.
2. A letter from the government entity responsible for the contract or project must be provided to the Public Authority for Manpower, confirming the contract's conclusion and that the workers are no longer needed.

3. At least one year must have passed since the worker was hired under the government contract.

4. The employer with whom the worker is registered must approve the transfer.

5. An additional fee of 350 dinars must be paid.
